1. About These Terms
These Terms and Conditions govern your access to and use of the Nexus Global Safety Platform, including the Nexus mobile application, the Nexus Operator Hub, and any associated services (collectively, the "Platform"), operated by NDS Solutions Ltd, a company registered in England and Wales ("we", "us", or "Nexus").
By creating an account, downloading the application, or using any part of the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
2. Who We Are
NDS Solutions Ltd is the operator of the Nexus Global Safety Platform. Our registered office is in Liverpool, United Kingdom. The Platform is currently active in the United States, with operations centred in Austin, Texas.

3. The Platform And It's Purpose
The Nexus Global Safety Platform is a personal safety system that uses Bluetooth mesh networking, GPS location services, and AI-assisted coordination to help protect individuals and assist in missing person cases.
The Platform includes:
• Tier 1 — the Nexus public mobile application (free, available on iOS and Android)
• Tier 2 — the Nexus Operator Hub, for verified organisations such as venues, businesses, and community groups
• Tier 3 — the Nexus Command Console, for law enforcement and emergency services
• Rapid Alert — a missing person notification and coordination service
4. Eligibility
You must be at least 18 years of age to create an account on the Platform. By registering, you confirm that you are at least 18 years old and have the legal capacity to enter into a binding agreement.
If you are registering on behalf of an organisation (Tier 2 or Tier 3), you confirm that you have authority to bind that organisation to these Terms.
5. Your Account
5.1 Registration
To access the Platform, you must register an account using a valid email address and create a secure password. You are responsible for maintaining the confidentiality of your account credentials.
5.2 Accurate Information
You agree to provide accurate, current, and complete information during registration and to keep this information updated. We reserve the right to suspend or terminate accounts where false or misleading information is provided.
5.3 Account Security
You are responsible for all activity that occurs under your account. You must notify us immediately at security@nexus-global.ai if you suspect any unauthorised access to your account.
6. Acceptable Use
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must not:
• Use the Platform to transmit false, misleading, or fabricated emergency alerts
• File fraudulent missing person reports or confirm a person as found without genuine knowledge
• Attempt to access any part of the Platform for which you are not authorised
• Reverse engineer, decompile, or attempt to extract the source code of the application
• Use automated means to scrape, harvest, or extract data from the Platform
• Interfere with or disrupt the integrity or performance of the Platform or its infrastructure
• Use the Platform for any commercial purpose not expressly authorised by us
• Impersonate any person, organisation, or emergency authority
7. Emergency Services Disclaimer
THE NEXUS PLATFORM IS NOT A SUBSTITUTE FOR OFFICIAL EMERGENCY SERVICES.
In any life-threatening emergency, you must contact your local emergency services immediately. In the United States, call 911. In the United Kingdom, call 999.
While the Platform is designed to complement emergency response, we make no guarantee that alerts will be received, relayed, or acted upon within any specific timeframe. Network availability, device status, and geographic coverage will affect Platform performance.
We are not responsible for any harm arising from reliance on the Platform as a sole means of emergency communication.
8. Bluetooth Mesh & Location Services
The Platform operates a Bluetooth Low Energy (BLE) mesh network. By using the Platform, you consent to your device participating in the relay of anonymised, encrypted safety signals from other Nexus users in your vicinity when network conditions permit.
Relayed signals do not expose your personal identity to other users. All relay data is encrypted end-to-end.
Location data is collected and processed as described in our Privacy Policy. You may disable location services at any time via your device settings, but this will limit the functionality of the Platform.
9. Volunteer and Witness Registration
The Platform allows users to register as volunteers or witnesses in connection with missing person cases. By registering in either capacity, you confirm that any information you provide is truthful and accurate to the best of your knowledge.
Providing false information in connection with a missing person case may constitute a criminal offence under applicable law. We will cooperate fully with law enforcement authorities in such circumstances.
10. Rapid Alert Service
The Rapid Alert service allows registered users to publish missing person alerts across multiple channels. By submitting an alert, you confirm that:
• You have a genuine and reasonable basis to believe the person is missing
• The information provided is accurate to the best of your knowledge
• You have the right to publish any photographs or personal details included in the alert
Misuse of Rapid Alert, including submitting false or malicious alerts, may result in immediate account termination and referral to law enforcement.
11. Operator Hub (Tier 2) and Command Console (Tier 3)
Access to Tier 2 (Operator Hub) and Tier 3 (Command Console) is subject to additional verification and approval by NDS Solutions Ltd. We reserve the right to grant, suspend, or revoke access at our sole discretion.
Tier 2 and Tier 3 operators must ensure that their use of the Platform complies with all applicable laws, including data protection legislation in their jurisdiction.
12. Subscriptions and Payments
Certain features of the Platform are available on a subscription basis. Current pricing is published at nexus-global.ai/pricing and within the application.
Subscriptions are billed in advance on a monthly or annual basis. All payments are non-refundable except as required by applicable consumer law.
We reserve the right to change our pricing with reasonable notice. Continued use of the Platform after a price change constitutes acceptance of the new pricing.
13. Intellectual Property
All intellectual property rights in the Platform, including but not limited to the software, design, trademarks, and content, are owned by NDS Solutions Ltd or its licensors. Nothing in these Terms grants you any right to use our intellectual property except as necessary to use the Platform in accordance with these Terms.
Patent applications are pending in the United Kingdom and the United States in respect of core Platform technologies.
14. Limitation of Liability
To the fullest extent permitted by applicable law, NDS Solutions Ltd shall not be liable for:
• Any indirect, incidental, special, consequential, or punitive damages
• Loss of life, personal injury, or property damage arising from use of or reliance on the Platform
• Failure of the Platform to function in the absence of internet connectivity, Bluetooth availability, or GPS signal
• Any losses arising from unauthorised access to your account
Our total liability to you for any claim arising under these Terms shall not exceed the amount you have paid to us in the 12 months preceding the claim.
Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
15. Termination
We may suspend or terminate your account at any time if you breach these Terms, if we suspect fraudulent or abusive behaviour, or if we discontinue the Platform or any part of it.
You may delete your account at any time via the application settings. Upon deletion, your personal data will be handled in accordance with our Privacy Policy.
16. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of the Platform following notification constitutes acceptance of the updated Terms.
17. Dispute Resolution and Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions. NDS Solutions Ltd is incorporated in England and Wales; where Texas law does not apply, the laws of England and Wales govern.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform shall first be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Austin, Texas, or by remote hearing. The arbitrator's decision shall be final and binding.
CLASS ACTION WAIVER: You agree that any arbitration or legal proceeding shall be conducted on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights or confidential information.
If you are a UK or EU consumer, mandatory consumer protection laws in your jurisdiction may provide you with rights that cannot be waived by these Terms. Nothing herein limits those rights.
